Group 1

  • Annual Recurrent area related measure Axis 2, except Woodland Creation on non-agricultural land.

Late submission of forms

Standard deduction of 1% per day late up to 25 days

Over declaration

Scaled reductions depending on extent of over-claim; plus reductions in following year if over-declaration of above 50% is found. See How are Penalties Calculated for Over Claims for more details.

Non-respect of eligibility criteria or scheme rule breach

A penalty calculated depending on intent, extent, severity, permanence and repetition which ultimately could lead to disqualification.

Cross compliance and non-respect of protection of historical features

Standard deduction according to cross compliance penalty matrix (page 51) for rectifiable and unintentional breach. Penalties are applied to all the area related Options within the SRDP mechanisms.

The maximum penalty is the total amount of Annual Recurrent claim payment for that year.

Double claim with incompatible Options (cross check breach) on the same piece of land

The claim will be adjusted to remove one option and this may led to an over-declaration penalty.

Group 2

  • Measures under Axes 1 and 3; Establishment costs for Woodland Creation and non productive investments under Axis 2.
  • All corresponding measures under Axis 4.

Over-claim

If over-claim is less than 3%, the claim is reduced to maximum applied for or approved in contract, or to level supported by invoices if less than agreed amount. If over-claim is more than 3%, the claim will be reduced to its correct level as before, and an amount equal to the over-claim will be deducted from the eligible amount.

Recovery and exclusion for 2 years if the breach is found to be intentional.
