Community Right to Buy Guidance

The Community Right to Buy Guidance document is divided into three sections; Community Bodies, Landowners and Heritable Creditors and Third parties. This guidance includes information on, for example:

Community Bodies -

  • Initial Steps
  • Defining your community
  • Demonstrating community support
  • Applying to register your community interest in land
  • Effect of registration
  • Exercising your community right to buy

Landowners and Heritable Creditors -

  • The landowner and heritable creditor
  • The Register of Community Interests in Land (RCIL)
  • The registration process
  • Valuation of your land

Third parties -

  • Identifying your rights
  • Appeals

A model Memorandum and Articles of Association (M&A) is available from the Highlands & Islands Enterprise (HIE) website. This has been specifically designed to meet the requirements of the Community Right to Buy legislation. Other Associations have their own templates. You should ensure that your M&A meet your requirements.
