Rural Land in Scotland - Agricultural Holdings Pre-emptive Right to Buy

Pre-emptive Right to Buy

The pre-emptive right to buy offers additional opportunities for farmers who have tended secure holdings for many years to manage, develop and use that land.

Secure 1991 Act tenant farmers have a pre-emptive right to buy their holding when the landlord decides to sell. They must first register that right through application to the Registers of Scotland who maintain a register of tenants who have recorded their interest in buying the land they rent.
