Information on the recommended time periods for reaching each stage of the appeal process as laid out in the Scottish Executive Environment and Rural Affairs Department (SEERAD) Guidance Note

An appellant has a window of 60 calendar days from the date of an initial decision or appeal stage decision to lodge an appeal at each stage. The appeals booklet indicates that the stage 1 appeals review meeting will usually take place around six to eight weeks from the date the appeal was lodged. At stage 2 the meeting will usually take place within four to six weeks of the appeal request.

These timescales are however only indicative and depend very much on factors such as appeal volumes, producer availability and panel availability, with oral appeals tending to take longer to arrange the review meeting than written appeals. We (SEERAD) try to process appeals in date order to ensure fairness of treatment. The timescales in the booklet were created prior to the appeals system becoming operational and without practical experience of operational issue. We (SEERAD) intend to update these in the next revision of the booklet which reflects the introduction of CAP Reform.
