Purpose of this circular: To announce the coming into force of The Police (Scotland) Amendment Regulations 2009 and consequential amendments to Annex B of the determinations under the Police (Scotland) Regulations 2004.

The purpose of the SSI is to amend three separate instruments covering police regulations, that is, the Police (Promotion) (Scotland) Regulations 1996, the Police (Special Constables) (Scotland) Regulations 2008 and the Police (Scotland) Regulations 2004.
Regulation 2 of the SSI removes the "qualifying examinations" from the Police (Promotion) (Scotland) Regulations 1996 and leaves the Diploma in Police Service Leadership and Management as the only formal means to obtain a new qualification for eligibility for promotion to a rank above that of constable.
Regulation 4(2) removes the requirement for Assistant Chief Constables to have a fixed term appointment from the Police (Scotland) Regulations 2004 and requires the consequential amendment of Annex B of the determinations made under these regulations.
Regulation 4(3) allows forces to deduct any contributory employment support allowance, under the Welfare Reform Act 2007, from officers in receipt of full pay.
Special Constables Retirement
Regulation 3(3) amends regulation 8 of the Police (Special Constables) (Scotland) Regulations 2008 and allows a Chief Constable to postpone the retirement of a Special Constable.
Although Special Constables are volunteers and are not subject to police pension regulations, all forces should put in place a procedure similar to that set out in Scottish Public Pension Agency guidance on the compulsory retirement age for regular officers, issued on 12 December 2006.
This may include an assessment of skills and performance, a medical assessment and a role related risk assessment. Also, Special Constables should give the Force an indication of how long they wish to extend their service and Forces must define the duration of any extension of service.
