Dear Colleague

Purpose of the circular: To inform police authorities and joint police boards of the mechanism the Scottish Ministers will use under section 36 of the Police (Scotland) Act 1967 ("the 1967 Act") as substituted by Section 46 of the Crime and Punishment (Scotland) Act 1997, to determine amounts paid to them by police authorities and joint police boards.

The one new item in this year's determination is the Scottish Drug Enforcement Agency Operational and Intelligence Group (other than in relation to the costs of salaries and allowances of constables seconded by Chief Constables to that Group).

The arrangements for funding the Operational and Intelligence Group (IOG) of the Scottish Drug Enforcement Agency (which superseded the Scottish Crime Squad) have been finalised. The legal basis of the IOG is a collaboration agreement entered into in terms of section 12(1) of the 1967 Act. Those police functions which are discharged by virtue of that agreement are not regarded as common police services under section 36. Funding for officers who are based in forces, and engaged in dedicated drug duties, will be made available through police grant under section 32. Police authorities will also be given an additional amount of grant under section 32 for the costs of seconding officers to the IOG. However, in determining the amount of such grant there is deducted from the total of such costs the individual police authority's share (50% in total) based on the Common Police Services formula.

Other costs associated with the IOG are however regarded as a common police service and are funded under Section 36. Recovery of the police authorities' share of those costs is therefore included in this year's determination.

I attach the Common Police Services (Scotland) Determination 2002 providing for the recovery of the Scottish Ministers' expenditure on common police services in 2002-03. (The Determination is not available to add to the Circular).

A copy of this circular is enclosed for the information of the Director of Finance/Treasurer. Copies have also been sent to the police associations, the Convention of Scottish Local Authorities and the Accounts Commission.
