Where it has been determined that an applicant's claim is not eligible for compensation under either the statutory or the ex gratia scheme, they will be notified in writing.
All rejected applicants will receive a written explanation as to why they have been rejected under both schemes.
If an applicant wishes to appeal the Scottish Government's determination to reject their claim they must appeal in writing to the Scottish Ministers within 28 days of receipt of the rejection letter.
An extension of time of this 28 day period may be considered but this will depend on the individual circumstances of the case. If an extension of time is required to appeal, a written request should be made to the Scottish Ministers before the 28 day deadline, otherwise the case will be closed and no further action will be considered.
All appeals must be in writing and must provide details of the reasons (eg. new facts relevant to the application not previously known) as to why the application should be accepted.
If the rejection is upheld after the appeal process, the case will be closed and the Scottish Government will not enter into further correspondence regarding the case.
