Scotland's Mental Health Act Review

In January 2008 the Minister for Public Health announced the establishment of a group set up to undertake a limited review of the Mental Health (Care and Treatment) (Scotland) Act 2003.

Review Report

The group's report was presented to Scottish Ministers in March 2009.

Review Consultation

A consultation paper seeking views on the group's recommendations has been issued. The closing date for responding to the consultation is Friday 6 November.

The consultation attracted 82 responses and in March 2010 we published both the Review of Mental Health Law Consultation Analysis (which provides an analysis of all recommendations in the full report) and the Main Findings of that Analysis (which provides a summary of respondents' views on selected key recommendations).

SG Response to McManus

The Scottish Government Response to the McManus Review Report, dated 1 October 2010, now indicates how Ministers would intend to take forward the issues relating to advance statements, advocacy, named persons, medical matters and tribunals. The response consists of: a summary paper, setting out the consultation process and the main changes which the Government is proposing; and then the full Government Response to each of the original recommendations by the Review Group, which takes the form of a table, and also indicates where we consider that primary legislation would be required (a Bill to amend the 2003 Act), where we consider that secondary legislation would be required (changes to the Tribunal Rules, or to regulations) and where we would take forward the agreed recommendations by means of policy initiatives (such as Guidance).
