Code of Practice - Please note that the code was amended on January 15, 2009: Changes are as follows -

Chapter 3 -Adult Representation - Page 18, paragraph 5

To make clear that an adult with a mental disorder is automatically entitled to access independent advocacy services under the provisions of the Mental Health (Care and Treatment)(Scotland) Act 2003.

Chapter 6 -Interviews - Pages 28 and 29, paragraphs 1 and 9

Section 8 provides that an adult may be interviewed by a council officer and anyone person accompanying the council officer.

Chapter 9 -Assessment orders - Pages 38 and 39, paragraphs 11, 21 and 22

Chapter 10 -Removals orders - Pages 44 and 46, paragraphs 15 and 24

Chapter 11 -Banning/ temporary banning orders - Pages 53 and 57, paragraphs 14 and 42

Further information on incapacity to consent and undue pressure provided to clarify that where the adult does not have capacity to consent then the requirement to prove undue pressure does not apply. However evidence of lack of capacity will be required by the sheriff.

Self-evaluation of Adult Support and Protection Activity in Scotland: Resource Handbook

Adult protection activity in Scotland has been given added impetus through the Adult Support and Protection (Scotland) Act 2007. Self-evaluation of such activity has become a key requirement for multi-agency working. Following research undertaken prior to the Act, the Scottish Government commissioned the development of an approach to self-evaluation of adult protection activity which resulted in the Self-evaluation of Adult Support and Protection Activity in Scotland: Resource Handbook. The structure and use of the Resource is described and the full handbook is attached in the website link heading above as is information on a pilot exercise undertaken by 15 multi-agency partnerships. Positive aspects of use of the Resource as well as constraints on its use are also described.
