THE WATER UNDERTAKINGS (RATEABLE VALUES) ( SCOTLAND ) VARIATION ORDER 2002

1. I am directed by Ministers to draw to your attention to the above Statutory Instruments which came into force on the 31 March 2002 but which shall have effect from 1 April 2001.

2. The Electricity Lands and Generators (Rateable Values) (Scotland) Variation Order 2002 varies the Electricity Lands (Rateable Values) (Scotland) Order 2000 and the Electricity Generators (Rateable Values) Scotland Order 2000 following upon changes in the electricity industry consequential on the Utilities Act 2000. The variations take account of the fact that Scottish Power UK plc and Scottish and Southern Energy plc were required to transfer their generation, distribution and transmission activities to successor companies during the financial year 2001-02.

3. The generation successor companies are Scottish Power Generation Limited and SSE Generation Limited. The distribution successor companies are SP Distribution Limited, SP Power Systems Limited and Scottish Hydro-Electric Power Distribution Limited. The transmission successor companies are SP Transmission Limited and Scottish Hydro-Electric Transmission Limited. The 2002 Order inserts the relevant successor company name throughout the principal Orders. Consequential variations have also been made to the formulas within the Electricity Lands (Rateable Values) (Scotland) Order 2000.

4. The Water Undertakings (Rateable Values) ( Scotland ) Variation Order 2002 makes a minor variation to Schedule 2 to the Water Undertakings (Rateable Values) (Scotland) Order 2000. This variation corrects the apportionment figure used by South Lanarkshire, in the calculation of the rates due by the East of Scotland Water Authority. The apportionment figure should be 1177 and not 1777 as shown in Schedule 2 to the 2000 Order.
