The First Consultation
The first consultation exercise set out the proposals for the transposition into Scots law of the EU Environmental Liability Directive (2004/35/CE) (ELD).
This was the first of two public consultations carried out by the Scottish Government and focused on the policy intentions contained in the Directive. It ran from December 21, 2006 until March 23, 2007.
A similar public consultation was conducted for the other administrations of the UK.

The Second Consultation
The second public consultation exercise on transposition of the Environmental Liability Directive 2004/35/ EC was prepared taking into account the responses received from stakeholder from the first consultation exercise.
The second consultation exercise sought comments on the draft regulations, draft guidance, a quick guide and the draft Regulatory Impact Assessment (RIA) and ran for 3 months commencing on May 16, 2008 and ending on August 8, 2008.
A similar public consultation exercise was conducted for the other administrations of the UK.
