Wayleaves
A wayleave is an agreement to install plant and equipment on land and have access rights to maintain and repair it. A nominal annual payment is normally made by the developer to the land owner or occupier.
The hearing into the necessary wayleaves over land in the area of The Highland Council was held in Inverness on June 27-29, 2007. The Reporters recommended that the necessary wayleaves be granted as applied for, subject to conditions. Report Volume 1 - Beauly to the boundary of Cairngorms National Park. The report on outstanding necessary wayleave applications in the Highland Council area - Dundreggan Estate, Glenmoriston.
The hearing into the necessary wayleaves over land in the area of the Cairngorms National Park Authority was held in Newtonmore on September 19, 2007. The Reporters recommended that the necessary wayleaves be granted as applied for. Report Volume 2 - Cairngorms National Park
The hearing into the necessary wayleaves over land in the area of Perth & Kinross Council was held in Perth on October 31, 2007. The Reporters recommended that the necessary wayleaves be granted as applied for, except those at Monzie Estate, Crieff and Abercairny Estate, Crieff which should be refused. Energy Minister Jim Mather concluded that the arguments for a whole line outweigh the withholding of consent for these sections of the line and associated wayleaves. The hearing into the necessary wayleaves over land in the areas of Stirling and Falkirk Councils was held in Stirling between January 30 and February 1 2008. On the basis of evidence heard, the Reporters recommended that the necessary wayleaves be granted as applied for, except that at Glenside Farm, Stirling, which should be refused. Energy Minister Jim Mather concluded that the arguments for a whole line outweigh the withholding of consent for this section of the line and associated wayleave. Compulsory Purchase Orders
A Compulsory Purchase Order is an authorisation for the purchase of land or rights over land to install plant and equipment and have access rights to maintain and repair it. A one-off payment is normally made to the land owner. Public local inquires into the five Compulsory Purchase Orders were held on the following dates:
- Beauly - March 20-23, 2008
- Inverness - February 5, 2008
- Newtonmore - February 12, 2008
- Perth - February 14, 2008
- Stirling - February 15, 2008
The Reporters recommended that the Orders be confirmed by Ministers.
