The Crown Office and Procurator Fiscal Service comments are as follows:

Box 1: We would not favour the implementation of review procedures since that could add to the already extended timetables for awarding contracts and might well lead to frivolous review requests.

Box 6: We would favour the minimum periods as in the Directive.

Box 8: The standstill derogations should be implemented as a standstill has no point in these circumstances.

Box 10: We would favour the time limits being brought into line with those in the Directive rather than left vague as "promptly".

Box 11: We would favour prospective cancellation as more practicable and not relying on common law.

Box 12: We support this.

We have no view on Boxes 15 and 16

Box 17: We favour time limits as in the Directive.

We have no view on the remaining boxes.
