Prisoners released from an English or Welsh prison to an address in Scotland
46. The role of the police in respect of prisoners released on HDC from a prison in England or Wales to an address in Scotland is very similar to that detailed in Scottish Government circular JD 7/2008 http://www.scotland.gov.uk/Publications/2008/07/23112256/5, i.e. to apprehend prisoners whose HDC has been revoked and to return that prisoner to custody. The slight differences in the processes are detailed in the following paragraphs.
Release notification
47. Her Majesty's Prison Service ( HMPS) will notify police in Scotland of all prisoners being released on HDC from a prison in England / Wales to an address in Scotland. The contact details in circular JD 7/2008 will be used. HMPS will also advise the Metropolitan Police PNC Bureau.
HDC licence revoked - prisoner recalled to custody
48. Where a prisoner released on HDC from an English or Welsh prison to an address in Scotland has his or her HDC licence revoked, the Public Protection Casework Section ( PPCS) will notify the police contact point for the curfew address that the prisoner has been recalled from custody and is unlawfully at large. The PPCS will also notify SPS headquarters of the recall.
49. It is then for the police to action the recall notice, make arrangements for the apprehension of the prisoner and for his or her return to the prison local to the curfew address. Arrangements for the transfer of prisoners back to England or Wales will be made by HMPS.
50. There may be occasions where circumstances warrant a report being forwarded to the releasing prison, detailing concerns about a prisoners behaviour which do not warrant arrest but which may have a bearing on HDC. In the case of prisoners released from an English or Welsh prison, such reports (using the proforma contained in earlier HDC guidance) should be forwarded to SPS headquarters.
