Annex 2: List of protected species and natural habitats
1 'Protected species and natural habitats' in the Regulations covers certain species and habitats protected under EC legislation (the Habitats Directive and the Birds Directive). The Regulations refer to the EC-protected species and habitats covered as follows:
"protected species and natural habitats" means-
(a) (i) the species mentioned in Article 4(2) of Directive 79/409/ EEC or listed in Annex I to that Directive;
(ii) the species listed in Annexes II and IV to Directive 92/43/ EEC;and
(b) (i) the habitats of species mentioned in Article 4(2) of Directive 79/409/ EEC or listed in Annex I to that Directive;
(ii) the habitats of species listed in Annex II to Directive 92/43/ EEC;
(iii) the natural habitats listed in Annex I to Directive 92/43/ EEC; and
(iv) the breeding sites or resting places of the species listed in Annex IV of that Directive.
Article 4(2) of Directive 79/409/ EEC refers to regularly occurring migratory species not listed in Annex.
