5.0 Confidentiality

5.1 In cases where operators deem E-PRTR data to be confidential, they will advise SEPA as to the basis of its confidentiality. SEPA will consider these reasons in determining whether or not there is an overriding public interest in making the data publicly available. Any decision will be made in accordance with the provisions of the Environmental Information Regulations (Scotland)2004 14. If the data is held to be confidential, the type of information that has been withheld and the reasons for doing so, will be indicated in the annual report of emissions and transfer data to the European Commission and on the UK-PRTR.
