Consultation on Transposition of the Minor Amendments Affecting Land Based Provisions of the Sulphur Content of Marine Fuels Directive 2005/33/EC (and Amending Directive 1999/32/EC)

I am writing to let you know that we have today published a consultation paper seeking views on the Scottish Executive's proposals to transpose the land based elements of European Directive 2005/33/EC relating to the Sulphur Content of Marine Fuels ( SCFMD) within Scotland.

The SCMFD makes minor changes (in addition to the marine provisions) to the Sulphur Content of Liquid Fuels ( SCLFD) Directive 1999/32/EC which are mainly for the purpose of separating the land-based and marine based elements. The Executive intends to repeal the Sulphur Content of Liquid Fuels (Scotland) Regulations 2000 and make new regulations which include these amendments - the Sulphur Content of Liquid Fuels (Scotland) Regulations 2006.

The marine provisions within the Directive will be transposed by the Maritime and Coastguard Agency( MCA). The MCA will consult on these elements at a future date. Details when published will be available from the weblink below:

All respondents should be aware that the Scottish Executive are subject to the provisions of the Freedom of Information (Scotland) Act 2002 and would therefore have to consider any request made to it under the Act for information relating to responses made to this consultation exercise.

Next steps in the process

Where respondents have given permission for their response to be made public (see the attached Respondent Information Form), these will be made available to the public in the Scottish Executive Library by 1 January 2007. We will check all responses where agreement to publish has been given for any potentially defamatory material before logging them in the library or placing them on the website. What happens next ?

Following the closing date, all responses will be analysed and considered along with any other available evidence to help us reach a decision on petrol vapour recovery II.
