Consultation with Other Administrations

64. Scottish public authorities should consult any relevant UK administrations before disclosing environmental information provided by or directly concerning that administration, except where:

  • the views of the other administration can have no effect on the decision of the Scottish public authority, for example, where there is no applicable exception so the information must be disclosed under EISRs;
  • in the circumstances, consultation would be disproportionately costly or time consuming.

Environmental information supplied by a Minister of the Crown or by a department of the UK Government and held in confidence is not 'held' by a Scottish public authority for the purpose of the EISRs and hence is not subject to the Regulations.
