The 1994 Habitats Regulations apply in Great Britain but this consultation relates to amendments that will have effect only in Scotland including Scottish territorial waters out to 12 nautical miles. As previously mentioned, measures to achieve a similar aim in England and Wales are the subject of consultation by the Department for Environment, Food and Rural Affairs (Defra) for England and Wales.
9. Defra are also undertaking a consultation on draft regulations which will transpose the Habitats and Birds Directives beyond UK territorial waters. Provisions in those regulations will be applied in relation to the UK offshore marine area. The consultation on the Offshore Marine Conservation (Natural Habitats, &c.)
