    The Electronic Communications (Scotland) Order 2006 Consultation Responses Introduction

    This written consultation ( http://www.scotland.gov.uk/Publications/2006/02/24091824/0) sought agreement to proposals to make changes to several pieces of legislation, enabling the use of electronic communications and facilitating electronic delivery of services. Stakeholders were asked to complete a response form to indicate "Yes" or "No" to the proposed changes and add any comments they had on the proposals. Consultation took place from 24 February to 21 April 2006.

    The majority of respondents were in favour of electronic communications being offered as an alternative to current forms of transferring information. A number of respondents took the opportunity to comment on electronic communications in general with some raising concerns around levels of authentication of the electronic communication.

    These comments were helpful and the policy areas concerned within the Scottish Executive have taken the comments into consideration. As a result, where applicable, guidance notes will be issued by the Scottish Executive to the relevant bodies on what measures need to be taken to ensure the validity of the information being communicated.

    Some legislation listed for inclusion in the draft Electronic Communications (Scotland) Order 2006 was not taken forward to enable further consideration of the comments and where appropriate the legislation will be taken forward at a later date. This legislation includes:

    • The Road Traffic Regulations Act 1984
    • Regulations of Care (Scotland) Act 2001
    • Pet Animals Act 1951

    • Animal Boarding Establishments Act 1963

    • Riding Establishments Act 1964

    • Breeding of Dogs Act 1973

    • Dangerous Wild Animals Act 1976

    Following the consultation seven pieces of legislation will be amended in the draft Electronic Communications (Scotland) Order 2006.
