INTRODUCTION

The private rented sector in Scotland is important for many thousands of people. The Scottish Government has produced this guide on housing rights for all those who live in privately rented accommodation. It should also be helpful to those thinking of renting privately. As a private tenant you have duties to your landlord as well as rights - for instance to pay your rent on time and not to damage furniture or fittings. Such duties are part of the law.

But the law also gives you certain rights. These rights are very important Private tenants may be unsure about their rights or written leases may be unclear or not easily understood. Sometimes no lease has been provided.

This guide is designed to tell you what your main rights are and where to seek advice if any problems arise. Knowing your rights can stop problems and disputes arising - or getting out of control. It reflects the Government's commitment to helping you to know your rights.
