Chapter 2: Introduction
  • This consultation paper seeks views on the attached proposed new regulations for Great Britain.
  • The deadline for comments is 20 January 2004. They should be sent to the address below.

2.1 The Environmental Protection (Controls on Dangerous Substances) Regulations will, subject to comments received, be adopted shortly after the period of consultation. Member States are required to apply the provisions as from 15 February 2004.

2.2 This paper invites comments on the draft transposing Regulations at Annex I to be made by the Minister of State, Department for Environment, Food and Rural Affairs. A draft regulatory impact assessment of the Regulations is at Annex II.

2.3 The Scottish Executive Environment and Rural Affairs Department (SEERAD) is conducting a separate consultation. However, regulations will be made on a Great Britain basis by the Department for Environment, Food and Rural Affairs (DEFRA). The Department for the Environment of Northern Ireland will be conducting separate consultations in their regions and will be introducing their own Regulations to transpose the Directive.

2.5 The Scottish Executive will make the responses to this consultation paper available to the public and to the Scottish Parliament. If you wish your response to be kept confidential, please make this clear at the top of the front page. We will assume unmarked responses are suitable for public inspection. SEERAD will acknowledge responses and will publish an analysis of the responses after the consultation.
