The Waste Incineration Directive (Scotland) Direction 2003
The Scottish Ministers, in exercise of the powers conferred on them by section 7(1) and (2)(b) of the Environmental Protection Act 1990( a) and section 40(2) of the Environment Act 1995() and of all other powers in that behalf, hereby give the Scottish Environment Protection Agency the following direction:-
Citation, commencement and extent
1.-(1) This direction may be cited as the Waste Incineration Directive (Scotland) Direction 2003 and shall come into force on 1st April 2003.
(2) This direction extends to Scotland only.
Interpretation
2.-(1) In this direction-
"the Waste Incineration Directive" means Directive 2000/76/EC of the European Parliament and of the Council of 4th December 2000 on the incineration of waste();
"the 2000 Regulations" means the Pollution Prevention and Control (Scotland) Regulations 2000();
"the 2003 Regulations" means the Waste Incineration (Scotland) Regulations 2003(); and
"SEPA" means the Scottish Environment Protection Agency.
(2) Words and expressions in this direction which are also used in the 2003 Regulations shall have the same meaning as they have in those Regulations.
3. SEPA shall, on or before 31st December 2004, include as a condition in the authorisation (other than an authorisation of an activity mentioned in Section 5.1 of Part 1 of Schedule 1 to the 2000 Regulations) or, as the case may be, the permit of any existing waste incineration installation or mobile plant a requirement that the operator of such an installation or mobile plant make an application in respect of that installation or plant under regulation 3 of the 2003 Regulations.
