EXAMPLES (See paragraphs 20-33)

NOTE: These are calculated using fee levels effective from 30 January 1997.

a. Household Extensions and Alterations (Categories 5 and 6)

This category would include, for example, (where these are outside the terms of permitted development) an extension to a house or flat, a garage built in the garden of an existing house, a garden shed, a "ham" radio mast, or a CB aerial mounted on a mast which needs planning permission. It does not include, for example, a new house built in the garden of an existing one, the conversion of a house into flats or building an office or workshop for business use in the grounds of a house. Fee £90 or £180 where the application relates to the enlargement, improvement or alteration of more than one dwellinghouse.

b. Residential Development (Category 1)

i. Full application for 10 flats, 10 maisonettes and 25 houses on a site of 2 ha:-

10 + 10 + 25 at £180 per dwellinghouse = £8,100.

ii. For the same development, an outline instead of a full application:-

2 ha at £180 per 0.1 ha or part thereof = 20 x £180 = £3,600.

iii. For that case, following outline permission, an application for approval of design and external appearance for 25 of the dwellinghouses:-

Since the flat rate cannot apply, the fee is 25 x £180 = £4,500.

iv. For that case, a further application for approval of the same reserved matters for the remainder of the development:-

Since the flat rate cannot apply, the fee is 20 x £180 = £3,600.

v. For the same development, any further application for any reserved matters by the same applicant:-

Since fees equal to the amount at (i) above have been paid by that applicant, the flat rate fee is payable = £180.

Non-Residential Building Works (Category 2)

i. Outline application for an industrial estate of 5 ha:-

Since the site exceeds 2.5 ha the maximum fee of £4,500 is payable.

ii. For the same proposed development a subsequent application for the approval of reserved matters where the flat rate does not apply, in respect of a first stage of 1,000 sq m of industrial floor space:-

1,000 sq m at £180 per 75 sq m or part thereof = 14 x £180 = £2,520.

iii. Application for a new shop front or petrol-filling station canopy:-

Since the development creates no floor space the fee is £90.

iv. Application for an extension adding 70 sq m of floor space to commercial premises:

70 sq m additional floor space at £180 per 75 sq m or part thereof = £180.

v. Application to erect a perimeter fence which does not happen to be permitted development:-

This constitutes building works but creates no floor space. Nor is it plant or machinery. The fee is therefore £90 (similar examples of structures or erections constituting building works but not constituting plant or machinery include flagpoles and walls).

Agricultural Buildings (Category 3)

A full application for a poultry shed of total floor space 600 sq m. First 540 sq m = £180 + 60 sq m at £180 = £360.

Plant and Machinery (Category 4)

Application to install oil refinery equipment and associated pipes and tanks on a site of 1 ha:-

1 ha at £180 per 0.1 ha = £1,800.

(Other examples of plant and machinery include cranes, conveyor belts and non-domestic radio masts).

Application made necessary by virtue of a condition imposing a time limit on commencement of development or submission of details:-

Normal fees, as a fresh application.

Mixed Development (paragraph 33 and paragraph 9 of Part II of Schedule)

i. Outline application for 1,000 sq m of office space and 5 flats on a site of 0.5 ha:-

Since the application is in outline and the sites are one and the same, the fee is the same under either category of development:-

0.5 ha at £180 per 0.1 ha or part thereof = 5 x £180 = £900.

ii. Application for approval of reserved matters, if not subject to a flat rate fee, for a development of 4,000 sq m of mixed shops and offices and 60 dwellings:-

Since the floor space exceeds 3,750 sq m the maximum fee of £9,000 applies and since the number of dwellinghouses exceeds 50, the maximum fee of £9,000 applies. Fees for this kind of mixed development are added and the total fee is therefore £18,000.

iii. Application for full permission for a building incorporating 200 sq m of shops, 4 flats with a total area of 400 sq m and 30 sq m of common service floor space:-

The total floor space of the development occupies 200 + 370 +30 sq m = 600 sq m. The proportion occupied by shops is 200 ie one-third. One-third of the common service area (one-third of 30 sq m = 10 sq m) is added to the non-residential floor space.

200 + 10 = 210 sq m of shops at £180 per 75 sq m or part thereof = £540

4 dwellings at £180 = £720

TOTAL £1,260

iv. Application for use of land as a caravan site of 2 ha incorporating roads, hardstandings and a shop and service building of 150 sq m:-

Change of use £180.

Engineering and Other Operations on Land (Category 8)

i. Application for works on a caravan site with an area of 0.9 ha:-

0.9 ha at £90 per 0.1 ha or part thereof = £810.

ii. Application for an underground pipeline 100m in length on a site 15 m wide:-

0.15 ha at £90 per 0.1 ha or part thereof:

2 x £90 - £180.

(another example of such an operation is an underground storage tank).

iii. Application for exploratory boreholes for mineral prospecting within an area of 50 ha:-

Since the site exceeds 1 ha the fee payable is £900.

Conversion into Flats and Houses (Category 9)

i. Application to convert a single dwellinghouse into 3 flats:-

2 dwellings at £180 = £360.

ii. Application to convert a barn to 3 dwellings:-

3 new dwellings at £180 = £540.

Other Changes of Use (Category 11)

Application to convert a barn into a factory:-

Change of use at the flat rate = £180.

"Boundaries" Cases (paragraph 8a and paragraph 5 of Part II of the Schedule)

In these cases the fee is paid to the authority in whose area the larger or largest part of the development falls.

The fee is calculated as follows:

1. calculate the fee for the 2 applications as if unrelated;

2. calculate the fee as if the whole development was within the area of one planning authority.

The total amount of the fee must not exceed 150% of 2.

Examples

a. Applications to 2 planning authorities to extract minerals on a 27 ha site crossing their boundary:-

Step 1 application to Y for 12 ha - £10,800 Total
application to Z for 15 ha - £13,500 £24,300.

Step 2 the fee for a single application would be £13,500 (the normal maximum).

The fee payable is therefore 150% of £13,500 ie £20,250 and is paid to Z.

b. Applications to 2 authorities for a change of use of a site:-

Step 1 £360 (ie £180 per application).

Step 2 £180.

Fish Farming

The fee for such a planning application should be calculated using the relevant categories, as appropriate, and as follows:-

- the erection of buildings (Fees Category 2);

- the erection, alteration or replacement of machinery (Fee Category 4);

- the carrying out of operations concerned with the placement or construction of tanks, cages, ponds or raceways (Fees Category 8(c)).
